Association for the Education of Young Children has obtained from
the state of Michigan and federal government rights to the expressions “Month
of the Young Child” and “MOYC” as service marks
of the organization.
Application for these service marks occurred at the request of the
Michigan MOYC Steering Committee. The Steering Committee wanted exclusive
rights to market the MOYC name; and, it wanted to protect these two
expressions from exploitation by commercial interests and others who
may not have the best interests of young children at heart.
MiAEYC applied for Michigan and federal rights in the summer of 1991.
Final approval of the state service marks came in August, 1993, and
approval of the federal service marks came in August, 1994–all
retroactive to the dates of application.1
This gives MiAEYC exclusive rights to use the protected service marks
and the power to permit or prohibit their use by other organizations
or people.
Our attorney advised us that protection of the service marks2 requires
the following procedures:
1. Either or both service marks may only be used with MiAEYC permission;
2. The mark must always be used with the appropriate service mark
designation
(® or SM, see below), and preferably with one of the following statements:
(A) “Month of the Young Child is a registered service mark of the Michigan
Association for the Education of Young Children.”
(B) “MOYC is a registered service mark of the Michigan Association for
the Education of Young Children.”
(C) “Month of the Young Child and MOYC are registered service marks of
the Michigan Association for the Education of Young Children.”

Michigan Association
for the Education of Young Children has copyrighted the Month of
the Young Child® graphic of children.
This gives MiAEYC exclusive rights to use the protected graphic and
the power to permit or prohibit its use by other organizations or
people.
Our attorney advised us that this protection requires the following
procedures:
1. Use of the graphic or any part of the graphic may only be used
with MiAEYC permission
2. The graphic must always be used with the appropriate copyright
designation, ©
Permission to use the graphic or any part of the graphic will only
be granted for use on printed information in conjunction with the
expressions Month of the Young Child® and/or
MOYC® and in accordance with
Month of the Young Child® and
MOYC® service mark guidelines.
1 The federal application, made in 1991, was lost by the U.S. Patent
and Trademark Office; MiAEYC made a new application in summer, 1993,
which was accepted in July, 1994, and made retroactive to the 1993
application date. The Michigan rights are retroactive to 1991.
2 The law on service marks distinguishes between use of the mark and
reporting about activities related to the service mark. Thus, an organization
could describe MOYC in an article without receiving permission to
do so. It could not further its own business by using the service
mark without permission from MiAEYC (i.e., advertising and holding
a conference workshop on MOYC).
